Holidays (Increasing Sick Leave) Amendment Bill

Part One: General Policy Statement

The main purpose of this Bill is to increase the availability of employer-funded sick leave for employees. The Bill aims to better enable New Zealand employees to access sick leave when they are sick or injured, or when their spouse or partner or someone who depends on them for care is sick or injured. This will ensure that New Zealand’s minimum employment entitlements continue to reflect broadly agreed societal expectations about work and just treatment. The status quo is out of step with those expectations.

Regulatory impact analysis

2.3. Were any regulatory impact statements provided to inform the policy decisions that led to this Bill?

The Ministry of Business, Innovation and Employment produced a regulatory impact statement (RIS) on 13 November 2020 to help inform the main policy decisions taken by the Government relating to the contents of this Bill.

The RIS did not meet the threshold for assessment by the Treasury’s RIA Team.

 

2.3.2. Are there aspects of the policy to be given effect by this Bill that were not addressed by, or that now vary materially from, the policy options analysed in these regulatory impact statements?

YES

The policy reflected in the Bill retains the status quo for the maximum current entitlement (20 days), with a consequential reduction in the amount of sick leave employers are required to carry over from year to year (reducing from 15 days to ten days). The RIS did not consider this option and instead considered changing the provisions concerning the carry-over of sick leave between entitlement years, to allow employees to access up to 25 days of sick leave in any one year (compared to the current 20 days).

Extent of impact analysis available

Part Three: Testing of Legislative Content

Consistency with New Zealand’s international obligations

3.1. What steps have been taken to determine whether the policy to be given effect by this Bill is consistent with New Zealand’s international obligations?

MBIE’s Employment Standards Policy team has scanned the international labour and human rights conventions to which New Zealand is a signatory and has not identified any inconsistencies.

Consistency with the government’s Treaty of Waitangi obligations

3.2. What steps have been taken to determine whether the policy to be given effect by this Bill is consistent with the principles of the Treaty of Waitangi?

MBIE’s Employment Standards Policy team assessed the Bill against the principles of the Treaty of Waitangi and found that the Bill is consistent.

Consistency with the New Zealand Bill of Rights Act 1990

3.3. Has advice been provided to the Attorney-General on whether any provisions of this Bill appear to limit any of the rights and freedoms affirmed in the New Zealand Bill of Rights Act 1990?

The Government has indicated that this Bill will be subject to a full Select Committee process, and that this process will provide an opportunity for external consultation on implementing the Government’s policy of increasing sick leave.
